GymZone Service Agreement
This Agreement ("Agreement") is made between GymZone (referred to as "Company") and the User ("User") regarding the use of GymZone's facilities, equipment, applications, and services (collectively referred to as "Services"). By registering, accessing, or using GymZone's Services, the User agrees to all terms outlined below.
1. GENERAL
1.1 Acceptance of Terms
By using the Services, the User agrees to the terms of this Agreement. Please read carefully before proceeding.
1.2 Amendments
The Company may modify this Agreement at any time without notice. Continued use of Services signifies the User's acceptance of the revised terms.
1.3 Capacity Rules
Users must book sessions for the correct number of participants ("pax"). Exceeding the stated capacity is strictly prohibited and may result in account suspension.
2. REGISTRATION AND USE
2.1 Registration
Users must create an account via the GymZone app or website, providing accurate and complete personal details.
2.2 Usage Guidelines
• Users are solely responsible for ensuring proper use of equipment and adherence to safety standards.
• Any malfunction or damage must be reported immediately.
3. PAYMENT
3.1 Charges
Charges for the Services are displayed during booking. Payments are processed through the GymZone app.
3.2 Refund Policy
E-wallet balances can only be used for booking and are non-refundable.
4. CONDUCT AND RESTRICTIONS
4.1 Prohibited Conduct
Users must not:
• Damage equipment or facilities.
• Exceed session durations or capacity.
• Engage in harassment or unsafe behaviors.
4.2 Suspension Policy
Violations will result in account suspension as follows:
• First offense: 2-week suspension.
• Second offense: Additional 2-week suspension.
• Third offense: Permanent ban.
5. LIABILITY AND ASSUMPTION OF RISK
5.1 Acknowledgment of Risk
Users assume all risks associated with using GymZone, including injury or property damage.
5.2 Limitation of Liability
GymZone and its affiliates are not liable for damages arising from use of the Services.
6. INDEMNIFICATION
Users agree to indemnify GymZone from claims or damages resulting from improper use of the Services.
7. GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of Indonesia. Disputes shall be resolved in the courts of [Tangerang/Indonesia].
8. NO WAIVER
Failure by Gymzone to enforce any provision of this Agreement shall not be deemed a waiver of its rights or remedies. Any waiver must be in writing and signed by an authorized representative of Gymzone. Such waiver will not constitute a waiver of any subsequent breach or failure to perform.
9. TERMINATION OF AGREEMENT
Gymzone reserves the right to terminate this Agreement at any time, without prior notice or cause, and may suspend your access to the facilities or services at its sole discretion. By accepting this Agreement, you waive any claims, costs, or damages arising from such termination.
• Termination by Gymzone for Cause: If terminated for cause, no refunds will be provided for unused time or fees.
• Termination by User: You may discontinue use at any time, but no refunds will be issued for time or services already consumed.
10. SEVERABILITY
If any provision of this Agreement is deemed unlawful or unenforceable by a court, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
11. SURVIVAL
The following sections of this Agreement will remain effective even after termination: Limitation of Liability, Waivers, Assumption of Risk, Warranties, Indemnification, and all outstanding payment obligations.
12. PERSONAL DATA PROTECTION
Gymzone is committed to protecting your personal data. By using our services, you agree to allow Gymzone to collect, store, and process your personal information for the following purposes:
• Service Delivery: To provide seamless access to Gymzone facilities and services.
• Payment Processing: To validate and manage payments or refunds.
• Communication: To notify you of promotions, updates, or events.
• Compliance: To adhere to legal or regulatory requirements.
If you wish to withdraw consent or update your personal information, please contact us through the channels listed in Section 20. Changes will be processed within 14 working days.
13. THIRD-PARTY INTERACTIONS
Gymzone may feature third-party advertisements, promotions, or services within its platform. Any interaction with third parties, including transactions, promotions, or services, is solely between you and the third party. Gymzone is not liable for issues arising from such interactions.
If you opt out of third-party advertisements, Gymzone reserves the right to charge a higher fee, which will be clearly stated on our official website. Always exercise caution in interactions with external providers.
14. ABOUT US
The Gymzone website and services are owned and operated by Gymzone Pte. Ltd. All Singapore transactions and user agreements are governed by Singapore law under the jurisdiction of Singapore courts.
15. GOVERNING LAW
This Agreement is governed by the laws of Singapore. Any disputes arising under this Agreement will be resolved under the jurisdiction of Singapore courts.
17. PROTECTION OF GYMZONE PRODUCTS
Unauthorized use, reproduction, modification, or reverse engineering of Gymzone's systems, programs, or related products is strictly prohibited. Gymzone will pursue legal action for any infringement, including but not limited to attempts to extract source code or obtain raw data.
